Bill's chef jailed and waiter fined after brawl on work night out in Brighton

A breakfast chef and father-of-one will spend up to three months in jail following a fight on a work night out.

Hubert Mikolaszek, of Claremont Road in Seaford, was sentenced yesterday at Brighton Magistrates’ Court after pleading guilty at a previous hearing.

The 24-year-old who works at Bill’s restaurant in Cliffe High Street, Lewes, was charged with assault by beating following a pub fight on October 9.

His colleague, waiter Lee Lipscombe, joined him in the dock charged with the same offence

Mikolaszek, who is from Poland and has a one-year-old daughter, was on a night-out with colleague and co-defendant Lee Lipscombe, of Cliffe High Street, Lewes, at a pub in Little East Street, Brighton.

After repeated attempts by other regular customers to quieten the men down, they were told to leave by patrons Benjamin Davey and Aaron Heano.

A CPS spokesman said: “Mikolaszek then approached Heano and knocked him to the floor. He was on his back and the defendant kept kicking him on the ground.”

Heano was later taken by ambulance to Royal Sussex County Hospital in Brighton and had to be anesthetised in order to treat a dislocated elbow and torn ligaments.

Mikolaszek will now serve a minimum of six weeks in prison. Lipscombe, 21, was given a 12 month community order, 100 hours unpaid work and to pay £145 in fines.

He was told by the judge he escaped a custodial sentence because he did not cause any injury and showed remorse for his actions.
