Scalded baby fighting for his life

A baby is in a critical condition after it suffered third-degree burns when a jug of hot water was knockd into his pushchair in a coffee shop.

Dean Betts and Marie Josefsson say 18-month-old Lewis has been left with burns to 21% of his body after the accident.

They claim 18-month-old Lewis, who is on a ventilator, will need treatment for the rest of his life and has been permanently disfigured.

He has undergone skin grafts to 5% of his body and remains critical condition at a hospital in Chelmsford, Essex - more than a week after the spill.

Postman Dean, 38, said he was heartbroken by his son's injuries which will leave him scarred for life.

He said: "I'm not entirely sure how it happened. We were waiting in the queue to pay and there was a tray on the counter above Lewis' pushchair.

"He was sleeping but suddenly I saw something move out of the corner of my eye. The next thing I knew, there was scalding hot water on his face, neck, back and chest.

"It was the worst experience I have ever had to deal with. To hear him crying out in pain and see him reaching out to me but knowing there was nothing I could do was utterly heartbreaking."

Another customer shouted to staff for help but then rushed the baby into the kitchen herself.

Mr Betts added: "She was amazing. We were knocked for six, totally panicking, but she took the reins and knew exactly what to do. She grabbed Lewis out of his pushchair and rushed him into the kitchen.

"She stripped off his clothing and started hosing him down under the cold tap.

"Without her things could have been much worse. I really wish she would come forward so we can thank her properly."

Mr Betts, who lives with his partner Marie, 33, herself a cafe assistant, in Bexhill, has been in touch with his solicitors and is considering bringing legal action against the cafe.

The pair are currently living in a family room at the hospital 90 miles from home.

Health and safety bosses are probing the circumstances behind the incident. Inspectors are due to visit the shop and the family has sought legal advice.

Mr Betts said: "We're not very happy to say the least, which is why we have taken it up with our solicitors. They say we have a good case.

"In the meantime, we need to make sure our little boy gets better. We are spending every minute of the day and night by his side.

"He has been totally knocked out for the last few days on sedatives and painkillers. Some days we just fall apart but we know we have to be strong for him.

"He could be in here for another week before they send him for more plastic surgery and he will probably have to have regular skin treatment for the rest of his life."

Cafe boss Stephen Jempson, who owns a chain of cafes, said: "I can't comment while investigations are ongoing for insurance reasons but I can confirm that a first aider was on site at the time of the incident.

"After an internal review Jempsons is happy with the efforts and assistance that our colleagues in the cafe offered.

"The thoughts and best wishes of all those who work at Jempsons are with the family at this time. We extend our best wishes for a full recovery."

I really felt for the parents until I read the bit about them trying to gain financially from the cafe owner. I'm sure no-one deliberately pushed the jug onto the baby, it was an accident. These things will happen every now and then, best to accept it and concentrate on looking after their baby rather than focusing on greed. They complain that the cafe staff didn't help but what use were they themselves?? Harsh, but true.

Accidents happen. Let's not go down the American route of resorting to overpaid lawyers to extort dirty money! Just concentrate on getting your son better, and remember, it was you who placed him under the counter, very risky as you've found out the hard way!

Have any of you actually had a similar experience? It is completely understandable that the primary feeling of the parents is anger at what has happened to their little boy. You should not pass judgement - the parents know what is best for their family, not you.

I have been in a coffee shop where this happened to child on a different occasion and they had no idea what to do the attendent was putting paper tissues wet on him until i suggsted standing him in water.Training should be given in these places.

Granted, a small point in the scheme of things but I do wish that, when writing these reports, the Argus would actually remember to give the LOCATION?

As for the whole legal action thing...well, of course, as we all know, legal redress just isn't something for ordinary working joes is it. Film stars and politicians can pick up millions in "libel" damages for some imagined slight, but ordinary people who've suffered can never get anything. I don't know if they have a case but they don't deserve to be rubbished by lamebrains like "Roy Hills".

The point is Andy R that they shouldn't be looking for a case at a time like this, they should be concentrating on caring for their child. To think of money and passing blame at a time like this is frankly shameful.

So what unique insight do you have that qualifies you to say that they do not have the interests of their child uppermost in their minds then? Like I said, an ordinary working person has the temerity to seek to use the law and your tiny judgemental minds have gone into overdrive.

Has anyone stopped to consider that this child is probably going to need skin grafts and possibly some form of plastic surgery? Do you really trust the NHS to do a good job of this? Perhaps the parents want compensation to pay for some decent treatment for their son, didn't anyone think of that? People are so quick to judge these days.

Just like other posters there I was reading & thinking wow heres a rare case toaday where someone hasnt pointed the finger of blame until...

"has been in touch with his solicitors and is considering bringing legal action against the cafe."

Dear oh dear..I can understand this child will need medical treatment and its life will be affected fair enough but were the cafe owners to blame? What if it was caused by another customer or god forbid it was an accident? Then what for the cafe owners?

If it is really proved they werer directly responsible then I can understand otherwise this selfish couple are just turning us more and more into the litigation nation..shame on you..

This sort of thing would never happen in a Starbucks. Yet for some reason, people want to deny our right of choice for the best coffee in St James Street.

More importantly though, I hope the infant makes a speedy recovery and suffers no lasting disfigurment

Firstly, my thoughts are with the poor child and his family. Secondly, if the parents want to pursue a claim it is completely reasonable, the costs they will incur bringing up their child with his injuries will be considerable and it is not the cafe owner that will pay, it will be his insurers through the public liability cover on his insurance, which is in place for this very thing. It shows that the parents are thinking of his future by considering a claim and not a lack of compasion or money grabbing. All the people who have made comments about it being wrong to claim, are you being honest to yourselves, you would do exactly the same, I guarantee it!!

But the whole point is that neither you nor or I or anyone pontificating here knows the answer to any of your questions!

So what's the problem with them seeking legal advice, and depending on the nature of that advice, seeking to test in court whether anyone was negligent?

Given the difficulties that their child may face in the future this is the responsible thing to do.

I never claimed to know any of the facts, it seems the family doesnt even know exactly what happenned : "saw something move out of the corner of my eye" yet if you read the story it clearly says they have taken legal action against the cafe..

I dunno, my heart sank when I read this, it would be a shame if the cafe bears the brunt of what turns out to be an accident or something that they did not directly do.

I lament the possibility that this turns into another another case in blame culture..

Er....I suggest YOU read the story, which says that they are taking legal advice and considering legal action.

If they have no case a responsible solicitor will advise them so. If they go to court and the establishment is found to be blameless they won't get a penny and in fact may be left with costs.

Hardly the route to easy money that some of the "compo culture" mythmakers like to portray on here.

have the parents before they called a local firm of no win no fee solicitors......??

these places where parents let their children run free climb over the funiture and when you tell them to control their children they get offended parents need training. From a coffee shop owner

these places where parents let their children run free climb over the funiture and when you tell them to control their children they get offended parents need training. From a coffee shop owner

tad from hove, yeah great comments, such maturity shown their..I do have a job and no its not bye bye as you are reding this!

Andy from Hove, you can nitpick over individual words if you wish but it is meaningless in relation to the debate sparked as a result of this story about blame and solicitors..

lets see shall we..I will be interesed to read the next chapter of this story if it appears in teh Argus.

God what bloody awful comments on here. None of you were there and how can you judge the family like that ? It may be that this gives the family something to concentrate on while Lewis is still getting better. I have been in many a cafe where the staff appear to be clumsy and accident prone ! And there's another important thing, the parents would not get anything as the money goes to the child when he is 18 as i am sure the solicitor would tell them !here's hoping the little lad makes a speedy recovery.
