An accountant is to appear in court accused of killing his older brother in a car crash.
Joe Smith is charged with causing the death of James Smith in the accident on a country road near Burgess Hill a year ago today.
The Crown Prosecution Service (CPS) has taken the decision to prosecute Smith, 28, following months of deliberation.
Sussex Police passed a file on the case, codenamed Operation Caldbeck, several months ago to the CPS.
Prosecutors have now decided that Smith, of Tainters Brook, Uckfield, should appear in court to face a charge of causing death by dangerous driving.
He will appear at Lewes Crown Court on March 1.
Brother's tributes
A Sussex Police spokesman said: “The charge relates to a fatal crash on the B2112 on Sunday, December 11, 2011 when a Ford Ka driven by Mr Smith collided with a Volvo S40.
“His brother, James, 29, a passenger in the car, died in the collision.”
James was sitting in the front passenger seat when the cars collided.
The road was closed for about five hours following the crash with firefighters, police and paramedics attending.
James, also from Uckfield, died at the scene of the crash while his brother was taken to the Royal Sussex County Hospital in Brighton, suffering from a collapsed lung.
Smith has posted on Facebook about missing his brother and published pictures believed to be of them together.
On Facebook and in emails to The Argus, James, who grew up in Uckfield and attended schools there, was described as a great friend.
