East Worthing and Shoreham MP launches parliamentary attack on Sussex Police

A former minister has launched a scathing attack on Sussex police which spent six months investigating him for alleged racist abuse after describing a "nightmare constituent" as "unkempt".

Tim Loughton said Kieran Francis had serially abused him and his staff, including calling the MP a "f****** Nazi" and an "arrogant, racist lying a*******".

But when Mr Loughton responded in an email describing his constituent as unkempt and talking "self-serving b******s" Sussex Police began an investigation which involved the MP being interviewed under caution.

Former children's minister Mr Loughton, MP for East Worthing and Shoreham, said he will make a formal complaint against the force and also criticised Chief Constable Martin Richards' handling of his grievance.

Speaking in the Commons, Mr Loughton described how Mr Francis, from Shoreham, was a "serial complainer with more chips on his shoulder than McCain" but "when he doesn't get his way he becomes abusive".

Mr Francis complained to the MP after he was described in an internal Adur District Council document as "unkempt".

Mr Loughton said: "I investigated and then sent an email back to my constituent saying that, given the dictionary definition of unkempt is 'untrimmed, dishevelled and rough' the council's description - not mine - struck me as eminently accurate. Anyone who has seen a photograph of the pony-tailed, shaggily bearded Mr Francis could not but concur.

"For good measure, and uniquely in almost 16 years of being a constituency MP but probably unwisely, I let my true feelings get the better of me and referred to Mr Francis' latest whinges as 'self-serving nonsense' except the word I used in place of nonsense, the word I took off Mr Francis' own blog ... was b******s."

Racism complaint

The email led to a police complaint from Mr Francis, who claimed he was a Romany Gypsy and the term unkempt was racist.

The MP was interviewed under caution for 90 minutes on suspicion of sending a malicious communication, and it was more than six months before he was eventually informed that he was in the clear in February.

Mr Loughton criticised the response of the Chief Constable in a meeting last week. "I was treated by the Chief Constable Martin Richards as if I was not only the subject of ongoing criminal investigations but almost as if I had been charged and found guilty," he said.

Responding to the debate, Deputy Commons Leader Tom Brake said he had "no responsibility for the police and will not attempt to answer for the conduct of Sussex Police".

But he added: "I'm sure every MP present in the House will have sympathy with his remarks about the amount of time and resources devoted to this investigation given the nature of the allegations."

Sadly the police have brought themselves into disrepute in this case, and the matter should have been dropped on the day of mr Loughton's interview as it was clearly nonsense.

I think the police would be more than happy if someone told them that this sort of thing was NOT a priority, but sadly (and despite the fond misconceptions of many Argus correspondents, it would seem) they are not wholly masters of their own destiny. Whilst talking publicly about the operational independence of chief constables the reality is that the Home Office has over the last 20 or more years introduced lots of "priorities" "targets" and "directives", whilst at the same time publicly saying that the decisions are nothing to do with them. Which is fine if you believe that there's no such thing as hypocrisy in central government. But you also have to question the apparent righteous indignation of the saintly Mr Loughton. Could it be that, despite being the peoples' representative Mr Loughton is mainly upset by the fact that both the chief constable and the P&CC Mrs Bourne have declined to be sufficiently genuflective to suit Mr Loughton's ego? Does he protest too much? He's wasting time when he could more usefully be dealing with his constituents' real concerns, or maybe just even filling out his expenses claims...

Mr Laughton complains that is a waste of Police time yet he perpetuates the situation by dragging it on and on.

A criminal allegation was made against Mr Laughton. The Police cannot and must not dismiss an allegation without investigation just because it is made against an MP ( Cyril Smith ? ).

This now appears to have become an ego trip for a publicity seeking MP.

I hope Mr Loughton enjoyed his childish rant in the Commons.

From the pictures I saw there were about 5 other MPs there to hear it.

2 of them were asleep, Another 2 were playing "Rock, Paper, Scissors". The other one was following the racing at Cheltenham on his phone.

What a disgrace when an MP uses Parliamentary Priviledge to name and abuse one of his constituents on a personal and private grievance.

I wonder whether any legal action could be taken against him for wasting a great amount of public time? Obviously it is too much to hope that he would act honourably and step down.

I'm no Tory, but my sympathises are entirely with Mr Laughton. There is no way that his comments were in any way shape or form 'racist' or indeed any type of 'hate crime', the worst you can say is that he was 'slightly rude'. And it took the Police six months to work out that yes, it was a load of b******s and there was absolutely no case to answer.

I hope he sues for emotional distress.

Thank you for your kind words, much appreciated.
The reason that he (ab)used Parliamentary privilege, was because there is no legal recourse, and he is allowed to lie through his teeth, as he did. I have documents that categorically prove that he lied in the majority of his monologue, but I have apparently been sacked as a member of the public and now have no ability to reply, as I have no representation in the Parliament of my country.
Apparently MPs cannot sack constituents, however Loughton has decided to be so arrogant as to ignore all the rules associated with the position that he holds, and do this, so as he can't technically do what he has actually done, then I have no recourse whatsoever.

Oh hello HJarrs...we thought after you recent faux pas on another thread you had moved on, although seemingly not. In the spirit of supporting you I can save you the bother of having to criticise this post by doing it for you;see below.

As usual HJarrs has got it wrong! It is clearly not the police at fault here as they are following process. The issue lies with people like HJarrs who believe they know how to exploit these situations. the sooner the greens are out the better for us all.
