The Crown Prosecution Service is considering whether two teenagers arrested over the fire which ravaged Hastings Pier in October can be charged.
Sussex Police confirmed a file has been passed to the CPS but no decision has yet been made.
The 19-year-old men, from St Leonards, were arrested shortly after the fire and have been on bail ever since.
They were due to answer bail on Monday but have had their bail extended until April 23.
The fire, on October 5, took four days to put out and destroyed 95 per cent of the upper part of the pier.
