Developers are being taken to court by a council battling to get a children's playground built.
Brighton and Hove City Council said it has been “forced to take legal action” after New England Quarter developers failed to comply with a planning enforcement notice requiring them to build the playground near Brighton Station.
It said despite “numerous requests” to the developer, McAleer and Rushe Group, and the landowners, Albion Inns Ltd and Cookstown Developments Ltd. no work on it has been done.
The case will now be heard at Brighton Magistrates' Court on December 8.
Phelim MacCafferty, the chairman of the council's planning committee, said: “We are extremely disappointed that the developers have continued to ignore requests to provide this much needed facility for families living in the area.
“Failing to comply with the enforcement notice has left us with no alternative but to take legal action.
“The creation of a playground will not only be welcomed by local people but will enhance the area in Block K which has become an eyesore.”
No one from the developers was available for comment yesterday.
Last week it was announced that the final piece of the New England Quarter development was nearly in place.
The council's planning committee gave permission for a scheme including a hotel, office and homes which will complete the regeneration of the area.
