Police feared 'volatile' confrontation before Brighton shooting

Quick thinking police officers had to change their tactics to try to prevent an armed man becoming a danger to the public.

Plain clothed Sussex Police armed response officers shot robbery suspect Michael Fitzpatrick in the chest and abdomen in Rock Place, Kemp Town, after fearing their cover had been blown.

An inquest into Mr Fitzpatrick’s death was told that police feared he was a danger to the public and police officers.

The tactical firearms commander responsible for the operation to try to arrest Mr Fitzpatrick told the inquest jury in Brighton they feared their target could be carrying a gun and was likely to be “volatile” if confronted.

After hearing Mr Fitzpatrick could be on his way to the Sidewinder pub in St James’s Street, two teams of armed officers intended to try to arrest him.

But officers had to make a last minute change of plan and only one team of officers felt forced to try to stop Mr Fitzpatrick on February 10 last year.

Coroner’s officer Penny Bailey told the inquest that Mr Fitzpatrick had pulled the firearm on the officers who tried to arrest him.

Three armed officers confronted him and Mr Fitzpatrick was shot twice and killed.

Mr Fitzpatrick was wanted in connection with three armed robberies in Burgess Hill and was being linked to a string of others in Hove.

The tactical firearms commander, a chief inspector who can only be identified as C14, said Mr Fitzpatrick was considered to be even more dangerous because he had been previously convicted of an armed robbery where a victim was taken hostage, had been convicted of conspiracy to murder and had been arrested but not charged over a shooting.

Confrontation

Officer C14 said: “We wanted to find him en route, because going into a public house to try and confront him was going to be a lot more difficult."

C14 said he had just arrived at John Street police station when he heard his team saying they had located Mr Fitzpatrick through the radio.

He said the next transmission was “Shots fired. Shots fired.”

When he arrived at the scene a few minutes later, paramedics were in the process of putting Mr Fitzpatrick into an ambulance and one of the armed officers was standing guard.

Armed officers had visited several addresses linked to Mr Fitzpatrick in the week leading up to his death. They had also tried to track him down via pharmacies where he may have been trying to get prescriptions for HIV medication.

The inquest continues.

if he pulled a firearm, and was thought to be dangerous, then the police did their jobs correctly. you cannot have armed people running round the streets. ok, he MAY not have used it, but had a history of armed robbery, so the police could not take a chance.

Bean bags? You first! I would even hold your unicycle and juggling balls while you took aim.
I've found that the standard Cous Cous blowpipe can cause temporary blindness, though not necessarily stop a subsequent hail of bullets from the gunman.

Would the headlines have instead read "Officer fighting for life as police botch gunmans capture whilst playing with experimental baked-bean gun"?

If only this poor chap had just apparently been known to the police for carrying a long-ranged tazer...it could all have ended so differently

It's long been established that you don't bring a knife to a gun fight... so why should the police have used tazer, or a bean bag if the robber guy was offering lethal force by pulling a gun? Sounds plain dangerous

I know I might seem to be somewhat picky but where among all the statements that are based on whether police thought or suspected/might have been and previous history have the jury been told that he produced a gun? What make was it? Was he was in fact in possession of a firearm at all? Based on this report it appears that there is a lot of ducking and diving about whether or not the deceased was in possession of a gun, if it turns out that he did not then we need to be very concerned bearing in mind Sussex Police have something of a history for killing unarmed suspects this is something we the public have a right indeed a need to know

So Chief Inspector 'C14' 'in charge' heard on his radio that the Victim was shot and was down, and arrived some time later... ONLY One team felt it necessary to go ahead without the other team. No Commander on the Scene... So decision at PC or SGT level at most.. Usual Sussex Police Scenario.. I am not saying this scum bag did not deserve to die.. Just that Police have a history of cocking these things up... and Sussex Plod more than most!

The fact is Mr F was a serious criminal, not a wanna be gangster but a serial armed robber who carried a firearm in the streets of brighton and hove, previously taking a hostage to escape who knows what he would of done to resist arrest? fire wildly in the street hitting civilians?....the softness of uk laws hits hard at police for using leathal force where they must justify using the tools the uk goverment permits them to, but they are trained and employed to protect the public, and I think in this case they did just that!

You really are a prize idiot!! You obviously have no idea whatsoever of what your talking about! Less lethal options are ALWAYS made available however if there is a clear and obvious threat (handgun being pointed at you) you will shoot to STOP the threat. Stop watching CSI or any other yank crap and join the real world... Im guessing you have never put yourslelf on the "frontline" otherwise you would never say what you have!

So..my perfectly reasonable comment enquiring about the gun Fitzpatrick pulled on the police, and further comments about the need for transparency have been deleted buy The Argus. How very democratic of them...I thought we still had the right to free speech, but apparently not in the Green Republic of Brighton...

STOP SHOUTING! Ok it's clear that you're a mate of Fitzpatrick (or former cell mate?) the fact that he has a family is irrelevant, he would have been an embarrassment to his family - after all who'd be proud to have someone who's done time for conspiracy to murder as a father?
If his family don't like what people are saying then they shouldn't go on the internet.
