A man has been arrested on suspicion of killing his brother in a tragic car crash.

Police are investigating whether Joe Smith, 27, caused the death of his older brother James Smith in a smash in December.

James Smith, 29, was a front-seat passenger when the car his brother was driving collided with a Volvo on a country lane near Burgess Hill.

Joe Smith, from Uckfield, answered bail on suspicion of causing death by dangerous driving at the end of last week.

He was interviewed and released on bail until April.

A Sussex Police spokesman said: “The 27-year-old driver of the Ka was arrested by appointment on his release from hospital in December 2011 on suspicion of causing death by dangerous driving, and was subsequently released on police bail until February 23 this year.

“He was further interviewed on that date and then released again on police bail until April 25 whilst a report is considered by the Crown Prosecution Service.”

Serious injuries

The fatal crash happened on the B2112 between Wivelsfield and Ditchling, shortly after 1pm on Sunday, December 11, last year.

The road was closed for about five hours following the crash with fire-fighters, police and paramedics attending.

James, also from Uckfield, died at the scene of the crash while Joe was taken to the Royal Sussex County Hospital in Brighton suffering from a collapsed lung and broken pelvis following the accident.

“He has since recovered and was released from hospital but arrested and bailed soon after.

On Facebook and in emails to The Argus James, who grew up in Uckfield and attended schools there, was described as a great friend.

Witnesses to the collision should call Sussex Police on 101.
