A sun-bathing pensioner who removed his thong when police went to arrest him has escaped jail.

Serial flasher Richard Stofer – who in 2005 was given a five-year anti-social behaviour order (Asbo), banning him from stripping in public anywhere in Sussex – was handed a 12-week suspended jail sentence at Lewes Crown Court last week.

The 68-year-old former supermarket worker was jailed in 2008 for eight months because of his flashing exploits and breaching his Asbo.

The court was told that Stofer’s latest two offences related to him sunbathing naked on a public beach near his home in May, and taking his thong off when officers went to arrest him in June.

A Sussex Police spokeswoman said: “We are obviously aware of Richard Stofer and have worked hard to obtain evidence to charge and take him to court for indecent exposure. He is now on the sexual offenders’ register.

“We are working with partner agencies like Eastbourne Borough Council to try to deal with him.” The council said they could not comment on Stofer, of Milton Road, Eastbourne.

In July 2006, police caught him lying naked in a neighbour’s garden in Victoria Drive, Eastbourne, while she was out.

He exposed himself to staff at the Tesco petrol station near his home in Eastbourne in April 2007.

Stofer also spent five days in custody in 2007 for allegedly flouting his Asbo by sunbathing naked on Hollywell beach, Eastbourne.

In 2009, Stofer told The Argus he loved sunbathing naked.

Is there an offence of "indecent exposure"? Don't think so. It is not illegal to be naked in public, per se. The Offence is to INTEND to offend someone and for someone to actually BE OFFENDED. Maybe the latter is not difficult with people around like Crystal Ball. So much for tolerance!

You seem to have missed the part where the gentleman concerned has already been jailed and handed an Asbo for similar behaviour,. So, in the eyes of the Law, there has already been intent.

If you are happy to see an old man's winky then I am sure no-one will stop you.

I would not complain about Kelly Brook naked for instance (enjoyment of beauty -not offensive) , but I would complain about a wrinkly old bloke naked (ugly and offensive to me). Nothing to stop the man going naked in private though. Why don't the 'partner agencies' get him a permanent job at a naturist resort?

So this man has been arrested for sun bathing naked on a beach while hundreds can cycle naked through Brighton city centre and that's OK.
Surely it's either a criminal offence to be naked in a public place or it is not.

I am suprised that the Argus find this offender amusing. If The Argus bothers to look at his offences properly, they will see that the guy is a worrying pervert who gets off on exposing himself to people who have found it extremelydistressing and frightening as he is not just naked but strange, he is not just some bloke who likes sunbathing naked and is being harassed by the cops.
It's strange when a local rag finds such crimes amusing. Jimmy Savile was funny once too.

That is a very valid point, we have been here before on these threads, though I really would like the difference explained to me, as I find the naked bike ride particularly offensive. Last time I asked a Police Officer for an explanation as to why people are cycling naked around Brighton, his reply was "Hey ho each to their own" Obviously a professional!
