Duke of York's cinema forced to axe anti-war film

A celebrated independent cinema was forced to cancel a screening of a controversial film on Brighton and Hove Council's orders.

Duke of York's in Preston Circus, Brighton, pulled the anti-war documentary at the last minute after an environmental health officer raised concerns over its lack of a certificate.

Cinema staff say they were told police had contacted the council to inform them of the potential breach of their licence.

They say it is the first time in recent memory a film has been pulled for that reason.

The film-makers are accusing police of deliberately interfering with their freedom of speech.

But senior officers in Sussex Police's Brighton and Hove Division say the force played no part in a council officer's decision to contact the Duke of York's.

Films must have a certificate from either the British Board of Film Classification or councillors responsible for licensing before they can be shown commercially.

The cinema apologised for the cancellation and said it should not have scheduled the film without checking its certification.

Felicity Fenton, assistant manager at the cinema, said: "We were only contacted late this afternoon "The police contacted the council and the council contacted us.

"I've been here for five years. It has never happened before."

She acknowledged the cinema should have checked the film, which has been advertised since the end of February.

She said: "They are right. If we show the public an uncertificated film we are in breach of our licence.

"In the future we will be very careful about it."

The cinema hopes to reschedule the film for a later date.

Chief Inspector Laurence Taylor said police played no part in the controversial cancellation.

He said: "We would never get involved with certification of a film - it is not something we do.

"It was as much a surprise to us as anybody else."

After the cancellation the film was given two impromptu screenings at The Branch pub in London Road.

The campaigners hope to organise another screening today.

They believe the film's criticism of the police prompted the council's decision to enforce the licensing regulations.

The film is the story of Smash EDO's five-year campaign against the manufacture of weapons components at EDO MBM Technologies Ltd factories in Moulsecoomb and Fishersgate.

The activists believe the components are used in military actions in the Middle East which they claim are in breach of international law.

Several protesters have been arrested after locking themselves to factory gates, climbing onto their roofs and for 'bad karaoke' sessions where activists sing badly to disturb workers.

The group proudly boasts of its record of more than 40 arrests and its effect in bringing down the company's profits.

The film's advertising reads: "Using activist, police and CCTV footage plus interviews with those involved in the campaign, 'On The Verge' tells the story of one of the most persistent and imaginative campaigns to emerge out of the UK's anti-war movement and direct action scene."

Andrew Beckett, spokesman for the campaign said: "When the police are reduced to banning film showings via the back door another blow has been struck against our rights to free speech and free assembly."

Councillor Dee Simson, chairwoman of Brighton and Hove Council's licensing committee, said: "If there are ever any concerns about the ratings of films that are shown councillors are asked for advice.

"I haven't given any advice on that particular one.

"I know they would be in breach by showing anything that doesn't have a rating."

I thought the film was actually very good and I'm not normally a fan of this sort of thing. Strongly recommended. Made me feel very proud to be from Brighton.

I've seen it too and have to say its a great documentary full of serious action and wonderful satirical humour.
It makes Sussex police look pretty stupid. so not surprising they shut it down. But it makes you wonder what else gets censored that we never even here about.

While it might well have been an interesting film, I don't think the Smash EDO bunch did themselves any favours by standing around outside the DoY with a loud hailer banging on about 'freedom of speech'. If they'd had the sense to get thier film certificated before trying to get it screened, then it woul dhave been shown without any issue. Turning a simple administrative ****-up into some "shadowy censorship conspiracy" just made them look like prats. I fully support their efforts to stop EDO, but I wish they'd have a bath and grow up.

It's hardly a technicality, or even obscure, that films need to be cleared by the local council.

Just goes to show that the so called 'FREEDOM' we have in this country means nothing. To claim 'Freedom of speech' you have to get a certificate authorised by the authorities that the film partly campaigns against?... Wot a joke.

That's like asking the queen for her permission to chop her head off!

Smash EDO delibrately failed to get a certificate so they could hassle the police (who orginally ignored their petty pleas), hounded the council that the law was being broken etc. The film is absolute twaddle, Smash EDO are a bunch of lay about time wasters costing the Taxpayer money. I say ignore them and the little tykes will get bored, have a bath and move on.

Dave, Don't waste your time. If it is anything like Taking Liberties it will only be a one sided, non factual, 'all authorities are against us' load of tosh. Spend your time on something else. And yes the EDO lot do need to take a bath, it's a fact not just a lazy comment.

point 1 the film needed certification. point 2 any programe that perports to show the police in a bad light (especely if true)will be subjected to (in my opinion) perfidious efforts by high-ranking police officers to silence any such complaints by any means possable. this is in order to keep the proles in their place and also to keep these toadying sycophantic lickspittles in order that they might remain in good odour with their national-socialist labour masters.point 3 freedom of speech (most amuseing) beliveing in it and haveing it are two completly different things.point 4 did we just hear something tear! it sounded like Magna Carta ! I was irritated to show up to the Duke of York's only to be informed that the police had cancelled the film showing earlier that day. This will only make myself and others more curious to see this film about a passionate and creative campaign group. War profiteers are completely incongruous with the spirit of Brighton, perhaps they are startng to realise this.

It seems to me that a film being cancelled at the last minute is not because the police were suddenly informed of a lack of certificate, but for some other reason, that is being kept hidden from the general public.
Brighton is not the easiest place for me to get to, not being able to drive there, and having to rely on public transport from villages, so I was most disappointed, and some what angry, to hear that the film had been cancelled.
Surely this a a breach of our right to freedom of speech?

Congratulations to the Junior Orificer at Sussex Police who told the Council to do this without permission from his higher-ups at Brighton nick who openly acknowledge that it was a big mistake providing the best possible publicity for the film.

Venues all around the country that were showing the film have received harassment and intimidation forcing them to not show the film. we did go on to screen the film in a pub down the road from the duke of York to around 140 people. People all around the country have vowed not to let the scare tactics frighten them off. Some have even said they will screen it in thier own houses.
It costs 1,000 to get a proper certificate, many low budget some film of which this is don't get one and this has never been a problem for the Duke of York before. we even offered to go in as a 18, to no end. This is political. even if you don't agree with us, this is really serious attack on free speech. Maybe one day it will happen to you about something you care about.

Actually, Councillor Dee Simpson is wrong.

Documentary films, music, sport and other types of media are exempt from BBFC classification - i.e. they don't need it.
