Brighton man made 'rape threats' about daughter of his ex partner

Daniel Hoy had been put under a restraining order not to contact the Brighton woman, who The Argus has chosen not to name.

But in February he called her and made the threat when she was out with a mutual friend.

“I’m going to rape your daughter and **** her up the ****,” Hoy said.

He then bombarded her with Facebook messages for five days.

The victim was so scared she felt she had to leave the city.

She described him as a controlling man who fed off her vulnerability and labelled him a “vile, evil, manipulative predator”.

Hoy was also arrested by armed police in Whitehawk Way, Brighton, after he was seen stashing a sawn-off shotgun and ammunition in a gas meter cupboard.

At Hove Crown Court the 29-year-old admitted possessing a firearm and ammunition in a public place, and two charges of breaching a restraining order.

Judge Christine Henson QC jailed him for a total of seven and a half years.

She was told that Hoy was also the subject of a restraining order from another woman in 2014 when he had threatened to break down a door and kill the woman and her daughter.

The woman saw Hoy approach the door and knock, and saw him carrying a knife.

Richard Hearnden, prosecuting, said the latest incidents took place on February 16.

He said Hoy had been in an on-off relationship with the woman for 14 months.

She broke up with him after he had spat in her face.

Mr Hearnden said the victim heard Hoy’s “disgusting, vile and violent remark” which was repeated to her and recorded.

Hoy then launched a “diatribe of constant messages” because of his “resentment” of another man and made “vulgar and crude remarks” about the man’s libido.

There were 70 messages in total.

Stephanie Panchkowry, defending, said her client changed his plea to guilty when he heard the recording of his call to the victim.

But she denied that the recording included a rape threat, and claimed Hoy had only said he would “f*** her up the a*** you mug”.

Ms Panchkowry said Hoy has had trouble with drugs and alcohol and couldn’t remember using the abusive terms.

She said: “When he listened to the recording he found it disgusting, he was mortified.

“He has a great deal of remorse for acting in this way.”

Judge Henson QC said that while the sawn-off shotgun was unloaded, it was “clearly ready for use” with ammunition so close at hand.

She said his previous conviction showed Hoy was “prepared to use an offensive weapon”.

“You have an established record of violence and abuse,” she told him.

The judge said Hoy had used “vile and disgusting” threats.

She jailed him for seven years for possession of the firearm and ammunition, and added six a further months for the two breaches of the restraining order.
