Section 77 of the School Standards and Framework Act 1998 states the disposal of playing fields is permitted only with the consent of the Secretary of State.
Sport England, representing the Secretary of State, has clearly not given consent to sell the land at Ifield First/Deerswood Lower Special School site in Ifield to the highest bidder.
So, as consent has not been given, West Sussex Council Council is acting in defiance of the Act by clearing the site for housing developers.
