Plans for new flats opposite a fuel depot have been put on hold so planning officers can hold talks with the Health and Safety Executive (HSE).

Developers want to convert a clothing store chain's offices into 22 apartments overlooking Shoreham Harbour basin at Southwick. The three-storey block, rented by QS, stands opposite a Texaco fuel depot and the closest petrol tank is just 120m from the proposed flats.

They and existing homes could be at risk if there was a major explosion like the one in Hertfordshire last year.

Experts from the HSE originally objected to the scheme because of its proximity to the site. But they withdrew their concerns after the developer changed the layout of the plans by removing some of the front gardens and parking spaces.

Adur District Council officers recommended approval of the 14 two-bedroom and eight one-bedroom flats at the planning committee on Monday night.

But officers said the change in the layout seems to be "a contrivance" to get around the HSE's risk assessment.

A report to the planning committee states: "The living accommodation within the building itself remains just as close to the Texaco site. In real terms, the risk to the occupiers from any accident at the Texaco installation would be the same.

"The pragmatism of the HSE's assessment is further questioned bearing in mind the building is already occupied during working hours by existing office employees."

The planning committee gave approval to delegate powers to council officers to decide on the application following further observations from the HSE within the next 21 days.
