A supermarket has launched a legal challenge after its plans for a new store were turned down a second time.

Sainsbury's wanted to convert the former Caffyns garage in Preston Road, Brighton, into two retail units.

But the plans for its tenth store in the city were thrown out for a second time when Brighton and Hove City Council's planning committee heeded hundreds of residents wishes and unanimously voted them down in April.

Regeneration cabinet member Amy Kennedy has now revealed the firm has lodged an appeal against the decision.

Coun Kennedy, who will help present the local authority s case, said: "Residents are not saying no to any form of development.

"They are saying it has got to be the right one. "

She added transport cabinet member Ian Davey will join her presenting evidence at the Planning Inspectorate hearing on November 8.
