The father of actress Samantha Janus has been evicted from his home in Brighton.

Noel Janes, 53, left his flat in Windsor Street, carrying a suitcase and a bundle of clothes over his arm after a bailiff turned up.

Mr Janes, a former businessman, planned to stay with friends or relatives but not with his daughter, who lives in London.

He only told her about losing his home after his story appeared in The Argus.

Mr Janes, who receives incapacity benefit, claimed he was forced to move out after his rent was raised but his housing benefit wasn't.

He refused to pay the £10 a week shortfall from his £72-a-week benefit and was evicted for rent arrears.

He believes it is unfair that he and other tenants who receive housing benefit are expected to top up their rent if it exceeds the amount they receive from the city council.

He tried to challenge the law but his landlord took legal action to repossess the studio flat and last week at Brighton County Court he was given seven days to move out.

He said: "I have just fallen through the system and ended up like this. I did not think it would ever end like this. This is the reality of how people become homeless."

Mr Janes has been refused help by the city council's housing department. Because he failed to pay the rent, he is considered to have made himself intentionally homeless.

Despite having nowhere to go, Mr Janes said he believed he was lucky compared to others in the same position as he has friends and family he can turn to.

Mr Janes said he had a good relationship with his daughter but had no intention of asking her for help.

He said: "My daughter has got her own life. I believe in dealing with these things myself.

"I have told her what has happened and she said she supported me in what I have been trying to do."

Landlord Richard Blencowe, of Baron Homes, said: "We have been patient. It is an unfortunate position."
