One of a gang of men accused of raping a woman admitted to a police doctor he had sex on the night in question, a court heard.

Lewes Crown Court has heard how the gang was allegedly involved in raping and imprisoning the 21-year-old woman, who had been out celebrating her birthday at a Brighton bar.

It is alleged she was taken back to a flat in St Michael's Place, Brighton, where the offences occurred.

The jury heard yesterday how swabs were taken from all four defendants for DNA testing and a detailed search of the flat revealed a number of used condoms.

Defendants Pedro Baptiste, 19, of St Michael's Place, Menghis Bizabhu, 20, of Sackville Road, Hove, Serge Agro, 24, of no fixed address and Yafat Berhane, 18, of London, told police the woman had willingly stayed in the flat.

Berhane claims the woman instigated sex with him and he then went out to buy condoms.

He claims when he came back, the woman was having sex with Agro.

Doctor Elizabeth Carter, a forensic medical examiner, said while she was about to take swabs from Agro, he told her he had had sex with the alleged victim.

Dr Evans told the court that after she had told him what she was going to do during the examination he interrupted her and said: "I had sex with the girl."

PC Andy Sayers, of Brighton police, said when he searched the flat along with other officers he found a number of used condoms in the bottom of a plastic bag.

Baptiste denies false imprisonment, Bizabhu denies rape and false imprisonment, Agro denies rape and false imprisonment and Berhane denies rape and false imprisonment.

The trial continues.
