A convicted gnome thief found with a stolen statue of a naked woman has had his 33-month sentence cut.

In March Simon Fluendy, 31, of Ashburnam Road, Hastings, was jailed after admitting two counts of handling stolen goods and one of theft.

Mr Justice Longman, sitting at the Appeal Court with Lord Justice Kennedy and Mr Justice Ouseley, today reduced his jail term to 18 months, ruling the original sentences were too long.

On February 28 police arrested Fluendy for having two stolen dogs worth £250, the judge said.

The following week he was again arrested, this time for having a £700 stolen statue of a naked lady. On March 3 he stole a £30 terracotta urn.

The offences followed his release two months earlier from a four-year sentence imposed for, among other things, stealing garden gnomes, the judge added.

Reducing Fluendy's jail term to 18 months, Mr Justice Longman ruled that his original sentence for theft was not just "manifestly excessive" but longer than lawfully permitted.
