So far as Lewes District Council's (LDC) liability for costs for its appeal against the Falmer stadium are concerned, isn't it the case the initial hearing is merely to decide whether LDC has a case?
Should the court agree it has, there would be a further hearing and possible further appeals and further costs, for which LDC may be liable.
Even if it were to be successful, the court would only refer the matter back to the Department of the Environment.
Fortunately, LDC's purse seems to be bottomless, though I suggest councillors consider the question of personal liability.
Councillor Commin has, of course, undertaken to resign should the council's eventual liability exceed £25,000 over and above the £207,000 already spent.
Shouldn't the district's Council Tax payers be given some say before it is too late?
