Protesters arrested at a demonstration earlier this month are planning to take the police to court.
About 43 people were arrested on suspicion of a breach of the peace at Smash EDO’s protest in Moulsecoomb on October 13.
The group is now consulting solicitors over whether individuals can take civil action can be taken against Sussex Police for wrongful arrest.
Smash EDO – which claims the EDO factory in Moulsecoomb makes parts used in illegal military action - claims the arrests were made to prevent people demonstrating.
The group is also investigating whether legal action can be taken over the “kettling” tactic, where demonstrators were surrounded by police and forbidden to leave their spot.
The force did not comment on the possibility of legal action over the arrests yesterday.
